Abstract

Muslim coexistence in each corner of the world opens new ways of dealing with contemporary challenges. Their majority and minority count a lot The conditions are not the same. Since secularism has become dominant everyone has entertained religious freedom But living in a non-Muslim society Muslims come across various barriers that need to be dealt with in accordance with that environment because how can such a large majority migrate when no Muslim country is ready to give them citizenship? Secondly, Islam does not promote living in isolation from the world because its divine call is for every human being. Thus Muslim scholars need to provide specific jurisprudence that can guide those living in non-Muslim societies as the Muslims living as minorities do not have the power to impose their Shariah rules on those respective societies. They are obliged to abide by the rules of their respective societies. Thus the rule of change in the fatwa allows scholars to acknowledge the needs of human beings that adhere to the time, place, and specific conditions. The dissertation focuses on the acquisition of citizenship by Muslims in non-Muslim countries and all relations with non-Muslims, At the same time, the issues of family, marriage and divorce have been discussed in the light of the laws and conditions there. Opinions of jurists on all these issues which are both invalid and illegitimate, keeping in view the majority opinion, have also been written in the fatwas issued by the jurisprudential institutions.

There is a difference of opinion among the jurists regarding the judicial divorce of Muslims living in non-Muslim countries from their courts which do not have guardianship over Muslims so its decision cannot be enforced on the other hand opined that Muslims, like Jews, should be decisions according to their family laws by setting up of separate courts. There is a difference of opinion among the jurists regarding the jurisdiction in non-Muslim countries. It may not be known in this case that a non-Muslim elephant is not right on a Muslim. And he proved that he also considered this page to be the opinion of human beings of the day.
