STATUS OF TALAAQ AND KHULA'A IN ISLAMIC SHARIA

Abstract

Marital life is the essence and beauty of Human society. In this regard this article provides the guidance according to the teachings of Quran and Sunnah or rules of Sharia. This thesis provides the deep insight towards divorce by man(talaaq) and demand of divorce from woman (Khula'a) in the Islamic perspective and also describes the sharia rules governing this matter. Various types and conditions for talaaq are also discussed in this article. The sharia rules of Khula'a along with the family laws of Pakistani courts governing Khula'a are also described. Furthermore, the rising rate of divorce in Pakistan along with its reasons is also discussed such as, ignorance of Islam, mutual lack of trust, young age marriages, mutual intolerance, cheating, resistance towards second marriage of husbands etc. References are given at the end. This article is highly significant in the current scenario and can be very beneficial for the rectification of many mistakes which are leading the current society towards disaster and failure of family system.
